theFive — Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and theFive ("we", "us"), governing your access to and use of the theFive customer app and related services (the "Service"). By creating an account, or by accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Who may use the Service
You must be at least 13 years old. If you are under the age of majority where you live, you may use the Service only with the consent and involvement of a parent or legal guardian who agrees to these Terms.
You represent that you can form a binding contract with us and are not barred from doing so under applicable law.
You agree to use the Service only for lawful purposes and in accordance with these Terms.
2. Your account
You can create an account with an email and password, or by signing in with Google or Apple, and agree to keep your information accurate and current.
You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use.
Accounts are for individual use. Do not share, sell, or transfer your account.
3. What the Service does
theFive helps you discover participating local businesses and venues ("Venues"), join promotional campaigns ("Campaigns"), and collect and redeem digital coupons and offers ("Coupons"). Features may change, expand, or be discontinued at any time.
4. Coupons, offers, and Campaigns
Coupons and offers are made available by participating Venues, not by theFive. The Venue is solely responsible for honoring its Coupons and for the goods or services it provides.
Coupons are typically redeemed in person at a Venue by presenting a QR code in the App. We are not responsible if a Venue declines or is unable to honor a Coupon.
Unless a Coupon states otherwise, Coupons have no cash value, are non-transferable, cannot be combined unless permitted, and may expire, be limited in quantity, or be subject to additional terms shown with the offer.
We and participating Venues may modify, suspend, or cancel Coupons or Campaigns at any time, including for suspected fraud or abuse.
5. Third parties and Venues
The Service surfaces information about independent third-party Venues and other businesses. theFive does not own, operate, endorse, or control them and is not responsible for their products, services, conduct, content, pricing, or availability, or for any interaction or transaction between you and them. Any dispute with a Venue or other third party is between you and that party.
6. Location and maps
With your permission, the Service uses your device location to show nearby Venues and Campaigns. You can enable or disable location access in your device settings; some features may not work without it. Mapping features are powered by Google Maps and are subject to Google's Terms of Service and the Google Maps/Google Earth Additional Terms.
7. Acceptable use
You agree not to:
use the Service in any way that violates law or these Terms;
obtain, redeem, transfer, duplicate, or distribute Coupons fraudulently, or circumvent Coupon, Campaign, or redemption limits;
access another user's account or impersonate any person or entity;
interfere with, disrupt, probe, or overload the Service, or attempt to gain unauthorized access to it;
reverse engineer, decompile, scrape, or copy the Service except as permitted by law; or
upload or transmit malware or any unlawful, infringing, or harmful content.
We may suspend or terminate access for any violation.
8. User content
If the Service lets you submit content (for example, your profile), you remain responsible for it and represent that you have the rights to provide it. You grant theFive a non-exclusive, worldwide, royalty-free license to host, store, and display that content solely to operate and improve the Service.
9. Intellectual property
The Service, including the theFive name, logo (the "★ THE FIVE" star mark), software, and design, is owned by theFive or its licensors and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial use. No other rights are granted.
10. Third-party services
The Service relies on third-party providers, including Supabase (backend and authentication), Google, and Apple (sign-in and platform services). Your use of those features may be subject to the providers' own terms and privacy policies.
11. App store terms
You obtained the App through the Apple App Store or Google Play and agree to the applicable store's terms. For iOS, Apple is not a party to these Terms, has no obligation to provide support or maintenance for the App, and is a third-party beneficiary entitled to enforce these Terms against you. These Terms are between you and theFive only.
12. Account deletion and termination
You can delete your account at any time from Profile → Delete account. Deletion permanently removes your account and associated personal data (such as your profile, Coupons, and activity) and cannot be undone.
We may suspend or terminate your access at any time if you violate these Terms or if we discontinue the Service.
Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute provisions) will survive.
13. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any Coupon or offer will be available or honored.
14. Limitation of liability
To the maximum extent permitted by law, theFive and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless theFive from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the App or by other reasonable means and update the "Last updated" date. Your continued use of the Service after changes take effect means you accept the revised Terms.
17. Governing law and disputes
These Terms are governed by the laws of the U.S. state in which you reside, without regard to its conflict-of-laws rules, except where applicable federal law controls. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in that state, and you and theFive consent to their personal jurisdiction, except where applicable law gives you the right to bring a claim elsewhere. Nothing in these Terms limits the consumer-protection rights of your state of residence.
18. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and theFive regarding the Service.
