theFive — Business Privacy Policy

This Business Privacy Policy explains how theFive ("we", "us") collects, uses, and shares information in connection with the theFive business portal and the theFive point-of-sale and staff app (together, the "Business Services"), which are used by businesses and their authorized owners, managers, and staff. It is separate from the theFive consumer Privacy Policy, which applies to the customer app. It should be read together with our Business Terms of Service.

1. Who this Policy applies to

This Policy applies to businesses and their authorized owners, managers, and staff who use the Business Services. It does not govern the theFive consumer app — customers of that app are covered by the separate consumer Privacy Policy. Section 3 explains how we handle information about your own customers that you process through the Business Services.

2. Information we collect from business users

Information you provide

Account information: the name, email, password, and role of owners, managers, and staff. Passwords are handled by our authentication provider and are not stored by us in readable form.

Business information: details you add about your business and Venues, such as name, address, hours, photos, feature settings, and campaign and coupon details.

Billing information: subscription and payment details, processed by our payment provider (Stripe). We receive limited billing data (such as status and the last four digits of a card) and do not store full payment card numbers.

Communications: information you provide when you contact us for support.

Information collected automatically

Usage data: how you use the Business Services, such as features configured, dashboards viewed, coupons validated, schedules set, and related timestamps.

Device and technical data: standard information such as device type, operating system, app or browser version, and general connection information.

3. Customer information we process on your behalf

When you use the Business Services, you may collect information about your own customers — for example, a guest's name and phone number entered at the waitlist kiosk, or records of coupon redemptions. We process that information as a service provider on your behalf and on your instructions, to provide the Business Services. You are responsible for providing your customers with any required privacy notices and obtaining any required consents. We do not use your customers' information for our own independent marketing.

4. How we use information

We use business-user information to:

create and manage business accounts and authenticate users;

provide and operate the Business Services, including portal configuration, dashboards, campaigns, and point-of-sale and waitlist features;

process subscriptions, billing, and payments;

send service-related messages and, where permitted, product updates;

maintain the security and integrity of the Service and detect or prevent fraud and abuse;

analyze and improve the Service; and

comply with legal obligations and enforce our Terms.

5. How we share information

We do not sell your personal information. We share it only as described below:

Service providers: we use trusted providers to run the Service, including Supabase (database, hosting, and authentication), Stripe (payments), Twilio (SMS), Resend (email), and Google (maps and sign-in), who process information on our behalf under their own terms and privacy policies.

Consumer app: your public business information, Venues, campaigns, and coupons are displayed to customers in the theFive consumer app.

Legal and safety: we may disclose information if required by law or to protect the rights, safety, and property of theFive, our users, or others.

Business transfers: if theFive is involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction.

6. Notifications and communications

We may send you service messages and, where permitted, product updates. You can opt out of non-essential emails using the unsubscribe link. Any marketing you send to your own customers through the Business Services is your responsibility, including obtaining consent and honoring opt-outs.

7. Data retention

We keep business-user information for as long as your account is active or as needed to provide the Business Services, comply with legal obligations (including tax and billing records), resolve disputes, and enforce our agreements. Customer information we process on your behalf is retained and deleted as described in the Business Terms of Service and your instructions, except where retention is required by law.

8. Security

We use reasonable administrative, technical, and organizational measures designed to protect information, including authentication, access controls, and row-level security in our infrastructure. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. You are responsible for safeguarding your users' credentials and for promptly deactivating users who should no longer have access.

9. Your rights and choices

Access and deletion: owners can update business and account information in the portal and can delete the owner account from Profile → Delete account. Deletion permanently removes associated personal data, except where retention is required by law.

User management: owners and managers control which staff have access and can deactivate users at any time.

State privacy rights: depending on where you and your business operate (for example, under the California Consumer Privacy Act or similar U.S. state laws), you or your users may have rights to access, correct, or delete personal information. Contact us to make a request. We do not sell personal information.

10. International users

The Business Services are operated from the United States. If you access them from outside the United States, you understand that information may be processed and stored in the United States, where data-protection laws may differ from those in your country.

11. Changes to this Policy

We may update this Policy from time to time. If we make material changes, we will provide notice through the Business Services or by other reasonable means and update the "Last updated" date. Your continued use after changes take effect means you accept the revised Policy.
