theFive — Privacy Policy

This Privacy Policy explains how theFive ("we", "us") collects, uses, and shares information when you use the theFive customer app and related services (the "Service"). It should be read together with our Terms of Service. By using the Service, you agree to the practices described here. If you do not agree, do not use the Service.

1. Information we collect

Information you provide

Account information: your email and password, or — if you sign in with Google or Apple — the basic account identifier (such as your email) those providers share. Passwords are handled by our authentication provider and are not stored by us in readable form.

Profile and content: information you add in the App, such as your profile details.

Communications: information you provide when you contact us for support.

Information collected automatically

Activity data: Campaigns you join and Coupons you collect, redeem, or that expire, including related timestamps.

Location data: with your permission, your device location, used to show nearby Venues and Campaigns. You can turn this off in your device settings.

Device and technical data: standard information such as device type, operating system, app version, and general connection information.

We do not collect payment card information in the App; Coupons are redeemed in person at Venues.

2. How we use information

We use the information we collect to:

create and manage your account and authenticate you;

provide core features — discovering Venues, joining Campaigns, and collecting and redeeming Coupons;

show you nearby Venues and Campaigns based on your location;

send service-related messages and, where permitted, push notifications and email updates about Campaigns and offers;

maintain the security and integrity of the Service and detect or prevent fraud and abuse (such as Coupon fraud);

analyze and improve the Service; and

comply with legal obligations and enforce our Terms.

3. How we share information

We do not sell your personal information. We share it only as described below:

Participating Venues: when you collect or redeem a Coupon or join a Campaign, the relevant Venue may receive information necessary to honor it (for example, that a valid Coupon was presented and redeemed).

Service providers: we use trusted providers to run the Service, including Supabase (database, hosting, and authentication), Google (maps and sign-in), and Apple (sign-in), who process information on our behalf under their own terms and privacy policies.

Legal and safety: we may disclose information if required by law or to protect the rights, safety, and property of theFive, our users, or others.

Business transfers: if theFive is involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction.

4. Location information

The Service requests location access to show Venues and Campaigns near you. You can grant or revoke location permission at any time through your device settings. If you disable location, some features may be limited or unavailable.

5. Notifications and communications

With your consent where required, we may send push notifications and emails about Campaigns, Coupons, and updates. You can opt out of marketing emails using the unsubscribe link, and disable push notifications in your device settings. We may still send essential service messages (for example, security or account notices).

6. Data retention

We keep your information for as long as your account is active or as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. When you delete your account, we delete your account and associated personal data, except where retention is required by law.

7. Your rights and choices

Access and deletion: you can delete your account at any time from Profile → Delete account. This permanently removes your account and associated personal data (such as your profile, Coupons, and activity) and cannot be undone.

Location and notifications: you control location access and push notifications through your device settings.

State privacy rights: depending on where you live (for example, under the California Consumer Privacy Act or similar U.S. state laws), you may have rights to access, correct, or delete your personal information, and to not be discriminated against for exercising them. Contact us to make a request. We do not sell personal information.

8. Children's privacy

The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us and we will take appropriate steps to delete it.

9. Security

We use reasonable administrative, technical, and organizational measures designed to protect your information, including authentication and access controls provided by our infrastructure. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

10. Third-party services and links

The Service relies on and may link to third parties, including Venues, Supabase, Google, and Apple. Their handling of your information is governed by their own privacy policies, and we are not responsible for their practices.

11. International users

The Service is operated from the United States. If you access it from outside the United States, you understand that your information may be processed and stored in the United States, where data-protection laws may differ from those in your country.

12. Changes to this Policy

We may update this Policy from time to time. If we make material changes, we will provide notice through the App or by other reasonable means and update the "Last updated" date. Your continued use of the Service after changes take effect means you accept the revised Policy.
